1. ON-LINE CONTRACT DEFINITION
ATTENTION:
Tools and Co. deserve the right, at its own discreption, to accept orders. If not different communications is sent to the customer, the order is considered accepted.
All contracts concluded through direct access by the consumer and / or customer to the website corresponding to the addresses www.toolsandco.it, www.sherline.it and www.planesfactory.itfollowing the procedures indicated, will conclude the contract for the purchase of goods.
For distance contracts with consumers is explicitly invoked the rule contained in Section II of Legislative Decree no. 206, September 6, 2005 of the Italian Republic.
2. SELLING PRICES AND BUYING METHODS
All the prices shown are including VAT and any other tax; shipping charges varies depending on weight and size of the package,the customer will have to check for shipping charges in its shopping cart before confirming it. The customer may pay using the payment methods indicated on the web site.By the way, Tools and Co. may ask that the order is prepaid via bank transfer for new customer orders.
3. DELIVERY
Tools and Co. will ship the order using its selected couriers. In case of customer absence at the delivery address, usually couriers leave a message and will try again to delivery the package. Is responsibility of the customer to contact the courier to allow the correct delivery.
Delivery time may vary depending on final destination. For in stock items, Tools and Co. usually ships the next business day. International orders may take up to 10 days for delivery, depending on local Customs procedures and final country destination. The customer will always receive a shipping tracking number that he can use to contact the courier to obtain update delivery information.
4. PRODUCT AVAILABILITY
The customer can buy the products shown on the web site in the quantity available. I fan item is temporarily out of stock, Tools and Co. will contact the customer with information about the time needed for supply . In the case of an item indicated as available but not effectively in stock, Tools and Co. will refund any amount already paid by the customer which shall not be entitled to additional compensation
5. CUSTOMER OBLIGATIONS
Once the customer complete the submission o fan order, he must accept and print this “terms and conditions” rules and save it as part of the agreement.
Is prohibited to supply false, invented or incorrect information during the registration procedure; personal data and e-mail addresses must be true.
Is prohibited doing double or multiple registrations for the same customer or register a different person/company. Tools and Co. will sue any abuse or violation to protect customer rights.
Tools and Co. will have no liability for erroneous fiscal documents issued on the base of false, fake or incomplete information provided by the customer which is the sole person in charge for their accuracy.
6.AUTHORIZATION
Filling in the registration form needed to activate the purchasing agreement, the customer authorizes Tools and Co. to communicate the data needed for the processing of the order to the couriers and any other person necessary to the completion of the procedure. Tools and Co. will not transfer customer’s information to any other person unless requested by Italian or foreign Authority in respect of the current laws.
7.RESPONSABILITY
Any damage occurred during the shipment is responsability of the courier. The customer must inspect the shipment before accepting it and, in case of damage to the exterior package and/or missing parts, he must notify it to the courier immediately.
Tools and Co. has no responsibility for damages or delay caused by the courier.
Product images shown on the web site are only indicative.
8.WARRANTY AND ASSISTANCE
Products sold by Tools and Co. are covered by a one or two years warranty by the manufacturer (the complete warranty terms are included with every single item). Any repair or warranty claim is supplied directly by the manufacturer service centers. Tools and Co. will supply the list of service centers upon request.
9.WITHDRAWAL
9-1. As per art. 64 and following of the D.Lgs. n. 206/2005 of the Italian Republic, if the customer (ie a phisic person who buys the goods for its own personal use) has the right to cancel the purchase for any reason, without penalties except as provided in the following point 9-3
9-2. To cancel the purchase the customer will have to contact Tools and Co. via e-mail and notify a bank reference for the refund in the term of 10 days from the receiving of the shipment.

9-3. The withdrawal is under the following rules:

The withdrawal applies only to the complete item;

Is not possible to cancel the purchase only on part of the item (accessories, secondary parts, etc.)

The item will have to be returned complete and in its original package with everything inclided (manuals, accessories, power plugs, etc)

To avoid damages we suggest to put the original box into another shipping box. Do not apply for any reason stickers or adhesive tape directly on the original box.

goods with signs of use or damage or returned incomplete will not be accepted

goods with a different serial number than the original will not be accepted
-
there is no withdrawal on software product, books, manual, CD or DVD extracted from their original sealed package
-
the customer will have to pay the shipping charges for returning the goods

delivery of the goods is under the responsibility of the customer.

In case of damage or loss of the shipment, Tools and Co. will inform the customer that will have to claim against the courier. In this case the withdrawal will be cancelled

Tools and Co. will not be responsible for shipment returned without insurance
9-4. Except for the costs of restoration of the original box in case of damage, Tools and Co. will refund the amount paid by the customer in the maximum term of 30 days from the receiving of the returned goods. Shipping charges initially paid by the customer when bought the goods will not be refunded.
10. CLAIMS
Any claim will have to be sent via e-mail. The customer will receive an answer in the next 5 days
